The rules behind your choices.

These Terms of Service govern your access to and use of WhichYou websites, accounts, X/Y Choices, Monthly Results, readings, Insight and Guidance features, and related services.

Please read these Terms before using WhichYou.

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

WhichYou is a choice-based reflection and entertainment experience. It is not a medical, psychological, financial, employment, legal, or other professional decision-making service.

Agreement to These Terms

These Terms of Service ("Terms") form an agreement between you and the operator of WhichYou regarding your use of the Service.

"WhichYou," "we," "us," and "our" refer to the operator of the WhichYou Service. WhichYou is operated from Japan.

By creating an account, making a Choice, connecting a supported account, purchasing a subscription, or otherwise using the Service, you agree to these Terms.

The WhichYou Service

WhichYou is a digital experience built around repeated X/Y choices made across time.

Depending on availability, the Service may include:

  • scheduled X/Y Choices;
  • browser-based anonymous participation;
  • WhichYou accounts;
  • Choice History;
  • Official Tracking Source selection;
  • connected YouTube or Instagram features;
  • Monthly Results;
  • personality or themed readings;
  • Insight and Guidance features;
  • historical comparisons; and
  • other WhichYou content or features.

Features may be introduced, changed, limited, suspended, or discontinued as the Service evolves.

Eligibility

You must be at least 13 years old to create a WhichYou account or intentionally provide personal information through the Service.

If you are under the age of legal majority where you live, you should use the Service only with the permission of a parent or legal guardian where that permission is required.

By using the Service, you represent that you are legally permitted to do so and are not prohibited from using the Service under applicable law.

Your Account

Some WhichYou features require an account.

You are responsible for:

  • providing accurate account information;
  • keeping your account credentials confidential;
  • maintaining control over the email account associated with WhichYou;
  • activity performed through your account; and
  • notifying WhichYou if you reasonably believe your account has been compromised.
WhichYou support should never need your password, Google password, Instagram password, YouTube password, access token, or other secret credential.

You may not impersonate another person, create an account using information you are not authorized to use, or access another user's account without authorization.

Choices & Official Tracking Sources

Scheduled Choices

WhichYou may publish X/Y Choices on selected days during a calendar month.

The regular schedule may include Monday, Tuesday, Thursday, and Saturday in U.S. time, with no more than 16 official X/Y Choices in a calendar month.

Scheduling may change before or after publication when reasonably necessary.

Missing Choices

You are not required to answer every available Choice.

A Monthly Result may begin with as little as one official Choice when a Result Framework is available. More Choices may provide more information, but missing a Choice does not automatically invalidate your month.

Official Tracking Source

WhichYou is designed to use one Official Tracking Source for each calendar month.

Supported source types may include:

  • WhichYou.me;
  • Instagram; and
  • YouTube.

Availability of a particular source depends on whether the required technical connection is supported and successfully connected.

Once you select an Official Tracking Source, that source is locked for the remainder of the calendar month.

You may select a different supported source for a later calendar month.

WhichYou may refuse, ignore, or remove duplicate, corrupted, fraudulent, technically invalid, or unsupported choice records.

Monthly Results & Readings

WhichYou automatically processes your recorded Choices to produce product results, patterns, readings, and other insights.

During an open month, your current Monthly Result may change as additional official Choices are added.

After a month closes, WhichYou may preserve a closed-month result snapshot as part of your Choice History.

Result Frameworks may change

WhichYou is not required to use the same visible personality categories every month.

Different months may use different Result Frameworks, numbers of result categories, names, themes, weighting systems, or interpretations.

Results are interpretations

WhichYou results are product-generated interpretations of recorded choices.

They do not establish a permanent identity and are not guaranteed to describe every aspect of your personality or behavior.

WhichYou is not a validated psychological test, clinical diagnostic instrument, medical service, or professional assessment service.

Do not rely on a WhichYou result as the sole basis for employment, hiring, housing, credit, insurance, healthcare, education, legal, financial, relationship, or other consequential decisions.

Choice, Insight & Guidance

Free

Free WhichYou may include core X/Y Choices, Choice History, basic Monthly Results, and other free features.

WhichYou Insight

WhichYou Insight is available at $9.99 per month.

Insight includes your personalized monthly reading with sections such as:

  • Month at a Glance;
  • Your Monthly Reading;
  • What Shaped Your Reading;
  • Tensions;
  • Momentum;
  • Most Revealing;
  • Pattern in Context;
  • Month to Month; and
  • About This Reading.

WhichYou Guidance

WhichYou Guidance is planned for a later release and is not yet available.

Guidance may include Insight features plus longer-term analysis such as:

  • WhichYou Core Type;
  • Choice Style;
  • cross-month pattern analysis; and
  • other longer-term interpretations.

Current pricing, applicable taxes or fees, included features, renewal terms, and other material billing terms are shown before purchase. WhichYou may change future pricing or features prospectively.

WhichYou Insight subscriptions are available through the Service.

Billing, Renewal & Cancellation

This section applies to paid subscriptions.

Charges

Before you purchase a subscription, WhichYou will display the applicable price, billing interval, taxes or fees where applicable, and other material purchase terms.

Automatic renewal

WhichYou Insight is offered as an automatically renewing monthly subscription. Renewal terms are disclosed before purchase.

By purchasing an automatically renewing subscription, you authorize the applicable payment provider to charge the disclosed recurring amount until the subscription is canceled, subject to applicable law.

Cancellation

You may manage or cancel your subscription through the billing portal available from the Service.

Unless otherwise required by law or stated at purchase, canceling an automatically renewing subscription generally prevents the next renewal rather than immediately deleting remaining paid access for the current billing period.

Refunds

Refund eligibility, if any, is governed by the purchase terms presented at checkout and applicable law.

Nothing in these Terms limits refund or cancellation rights that cannot legally be waived.

Payment providers

Payment processing may be performed by a third-party payment provider.

The provider may process payment credentials under its own terms and privacy policy.

WhichYou does not intend to directly store complete payment-card numbers.

Acceptable Use

You may use WhichYou only for lawful purposes and in accordance with these Terms.

You may not:

  • access another person's account without authorization;
  • impersonate another person or misrepresent your identity;
  • attempt to bypass authentication, access controls, source-locking rules, rate limits, security systems, or technical restrictions;
  • manipulate or fabricate Choice records, connected identities, votes, comments, subscription status, or results;
  • introduce malware, malicious code, automated attacks, or harmful traffic;
  • scrape, crawl, harvest, or systematically extract Service data in violation of applicable law or technical restrictions;
  • interfere with or disrupt the Service;
  • use the Service to violate another person's privacy, intellectual property, or other legal rights;
  • reverse engineer non-public portions of the Service except where applicable law expressly permits it; or
  • use WhichYou results as an unauthorized substitute for professional or legally regulated assessments.

We may investigate suspected misuse and take reasonable action to protect the Service, our users, or third parties.

Intellectual Property

The Service and its original content are owned by or licensed to WhichYou and may be protected by copyright, trademark, database, and other intellectual property laws.

This can include:

  • the WhichYou name and branding;
  • logos and visual identity;
  • X/Y Choice prompts;
  • Result Frameworks;
  • result names and descriptions;
  • readings and written analysis;
  • videos and illustrations;
  • website design;
  • software and source code; and
  • original WhichYou methodologies, presentation systems, and product content.

Subject to these Terms, WhichYou grants you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for your own lawful, non-commercial use.

You may not reproduce, sell, license, redistribute, publish, create competing copies from, or commercially exploit protected WhichYou content without permission, except where applicable law allows.

Feedback

If you voluntarily provide suggestions, ideas, comments, or other feedback about WhichYou, you grant us permission to use that feedback to develop, improve, and operate the Service without an obligation to compensate you.

This does not transfer ownership of unrelated content or personal information you provide.

Third-Party Services

WhichYou may interact with or link to third-party platforms, including services operated by Google, YouTube, Instagram, Meta, payment providers, or other companies.

Those third parties operate independently from WhichYou.

Your use of a third-party service may be governed by that provider's own terms, privacy policy, technical limitations, and account rules.

WhichYou is not responsible for independent changes, outages, suspensions, restrictions, API behavior, or decisions made by third-party platforms.

A third-party integration may therefore become unavailable even when WhichYou itself remains operational.

Service Availability & Changes

WhichYou is an evolving Service.

We may change, add, remove, test, limit, suspend, or discontinue features when reasonably necessary.

This may include changes to:

  • Choice schedules;
  • Result Frameworks;
  • free features;
  • Insight features;
  • source integrations;
  • account functionality;
  • pricing;
  • technical infrastructure; or
  • supported devices or browsers.

We do not guarantee that the Service will always be available, uninterrupted, error-free, or unchanged.

Where applicable law or a paid subscription requires additional notice, we will provide it as required.

Suspension & Termination

We may suspend, restrict, or terminate access to some or all of the Service when reasonably necessary, including when:

  • these Terms are materially violated;
  • an account appears compromised;
  • fraudulent or abusive activity is detected;
  • use of the Service creates security or technical risk;
  • continued access would violate law or a binding legal requirement; or
  • the relevant Service or feature is discontinued.

Where reasonable and legally appropriate, we may provide notice or an opportunity to address the issue.

Certain provisions of these Terms that by their nature should survive termination may continue to apply, including intellectual property, disclaimers, limitations of liability, and other accrued rights.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

WHICHYOU DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR SUITABLE FOR EVERY PURPOSE.

WHICHYOU DOES NOT WARRANT THAT A RESULT, READING, SCORE, COMPARISON, INTERPRETATION, OR RECOMMENDATION WILL BE ACCURATE FOR EVERY USER OR EVERY SITUATION.

No professional advice

WhichYou content is provided for reflection, entertainment, and general informational purposes.

It is not medical, mental-health, psychological, legal, financial, employment, educational, relationship, or other professional advice.

You are responsible for decisions you make based on or after using the Service.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHICHYOU AND ITS OPERATOR, AFFILIATES, SERVICE PROVIDERS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

THIS MAY INCLUDE, WHERE PERMITTED BY LAW, LOSS OF DATA, LOSS OF PROFITS, LOSS OF OPPORTUNITY, BUSINESS INTERRUPTION, OR RELIANCE ON A WHICHYOU RESULT OR READING.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

ANY LIMITATION OF MONETARY LIABILITY APPLIES ONLY TO THE EXTENT PERMITTED BY APPLICABLE LAW.

Your Responsibility for Misuse

You are responsible for your own use of the Service and for violations of these Terms caused by your conduct.

To the extent permitted by applicable law, you may be responsible for losses or claims caused by unlawful misuse of the Service, infringement of another person's rights, fraud, or unauthorized access performed through your account.

This section does not impose obligations that cannot legally be imposed under applicable law.

Privacy

OurPrivacy Policyexplains how WhichYou collects, uses, stores, and discloses information associated with the Service.

The Privacy Policy forms an important part of understanding your use of WhichYou.

Governing Law & Disputes

These Terms and the Service are governed by the laws of Japan, without regard to conflict-of-law principles, except to the extent that applicable mandatory consumer-protection laws provide otherwise.

If a dispute arises, please contact us first atcontact@whichyou.meso that we can try to resolve the matter informally.

If the dispute cannot be resolved informally, it may be brought before a court having jurisdiction under applicable law.

Nothing in these Terms limits any non-waivable rights or remedies available to consumers under applicable law.

Changes to These Terms

We may update these Terms as WhichYou changes, new products are introduced, payment features launch, laws evolve, or our operational structure changes.

When updated, the "Last updated" date at the top of this page will be revised.

If a change is material and additional notice is required by applicable law, we will provide an appropriate notice.

Your continued use of the Service after updated Terms take effect may constitute acceptance where permitted by law.

General Terms

Entire agreement

These Terms, together with policies expressly incorporated into them, form the agreement governing your use of the Service, subject to any separate purchase-specific terms presented to you.

Severability

If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

No waiver

A failure to enforce a provision immediately does not necessarily waive the right to enforce it later.

Assignment

You may not transfer your rights or obligations under these Terms without permission where such restriction is permitted by law.

WhichYou may transfer these Terms as part of a merger, acquisition, reorganization, financing, or sale of the Service, subject to applicable law.
